Early Exit Option for 1-Year Commitment Members
The Early Exit Option allows you to cancel your membership before the end of your initial term. To cancel your membership, you must: 1. Be current on all Scheduled Monthly Payments. 2. You may terminate your one-year Commitment Membership at any time, for any reason, prior to the expiration of the membership term by providing us with 60 days prior written notice of your intent to terminate your membership. 3. Prepay your last two monthly payments via EFT/RCC. 4. Your Notice of Termination shall be your authorization for us to immediately charge your credit card or checking account on file for all Scheduled Monthly Payment amounts due during the 60-day notice period. Send the written Notice and final payment to: Early Exit Option C/O Bally Total Fitness ATTN: Cancellation Dept. 12440 E. Imperial Hwy. Ste. 300 Norwalk, CA 90650 5. If we are unsuccessful in processing your Scheduled Monthly Payments upon receipt of your Notice, then your termination request will be invalid. 6. During the 60-day notice period, and any additional prepaid days which remain, you are welcome to use all Bally Facilities to which your membership entitles you. You will not receive a refund of any monies paid to us prior to termination.
Early Exit Option for 18-Month and 2-Year Commitment Members
The Early Exit Option allows you to cancel your membership before the end of your initial term. To cancel your membership, you must: 1. Be current on all Scheduled Monthly Payments. 2. You may terminate your two-year Commitment Membership at any time, for any reason, prior to the expiration of the membership term by providing us with 90 days prior written notice of your intent to terminate your membership. 3. Prepay your last three monthly payments via EFT/RCC. 4. Your Notice of Termination shall be your authorization for us to immediately charge your credit card or checking account on file for all Scheduled Monthly Payment amounts due during the 90-day notice period. Bally 30-Day PromiseSM for 1-Year, 18-Month and 2-Year Commitment Members
The Bally 30-Day Promise allows you to cancel your membership if, after you follow the Program Rules, you are not satisfied with your results after the first 30 days of your membership. You must complete the following to qualify for the Bally 30-Day Promise during the first 30 days of your membership: 1. Participate in your Best Start WorkoutSM, which provides you with an orientation and counseling from a Bally Personal Trainer at no additional charge; OR complete at least one paid Personal Training session. 2. Visit a Bally club at least 10 more days (for a total of 11 visits), to take advantage of the facilities and the benefits of the program your trainer recommended. You must record each club visit by swiping your membership card. Only one visit per day is counted. 3. Make your first Scheduled Monthly Payment. 4. If you don’t believe you look and feel better you may cancel your membership. You will not receive a refund of any monies paid to us prior to our receipt of your written notice of cancellation, however you are welcome to use all Bally facilities to which your membership entitles you during any remaining prepaid period. Membership Freeze Program for 1-Year, 18-Month and 2-Year Commitment Members
The Membership Freeze Program allows you to put your initial Commitment Membership on hold (a.k.a. “freeze”), on a month to month basis, after you have been a member for at least one month, for a minimum of one month and up to a maximum of six months. During the freeze period, you will not be billed for your regular Scheduled Monthly Payments, but will be billed for a monthly freeze fee of $9.95 per month, which must be paid via EFT/RCC. During the freeze period, you may not use any Bally facilities. If you resume using the facilities at any time during the freeze period, we will resume billing you for your Scheduled Monthly Payments which must be paid via EFT/RCC and your freeze period shall end. Following the expiration of your freeze period, we will resume billing you for your Scheduled Monthly Payments, which must be paid via EFT/RCC. The term of the Agreement will be extended, on a month to month basis during the freeze period, by the number of months that you freeze your membership. You will not receive a refund of any monies paid to us prior to freezing your membership. To freeze your membership, you must: 1. Be a current member for at least one month. 2. Be current on all payments due under the Agreement through the date of your membership freeze. 3. Bally AssuranceSM for Premier National Access Commitment Members
If you find that the Scheduled Monthly Payment of your Premier National Access Commitment Membership is higher than the advertised monthly payment of the identical Premier National Access Commitment Membership currently offered to new members at your club of enrollment, then you can request that you pay the lower advertised monthly payment for the remainder of your initial membership term, if you comply with these Bally Assurance Program Rules. Your written request for a reduction of your remaining Scheduled Monthly Payments must be sent and postmarked during your initial membership term and within 30 days after the expiration date of the advertised lower monthly payment offered for this Membership. No refund of past payments will be made under the Bally Assurance Program under any circumstance. Your written request must be sent to: Bally Assurance Program C/O Bally Total Fitness ATTN: Price Assurance Dept. 12440 E. Imperial Hwy. Ste. 300 Norwalk, CA 90650 The Bally Assurance Program only applies if: 1. You signed your Premier National Access Commitment Membership on or after December 7, 2009 and purchased your membership by using a current/valid Recurring Credit Card (RCC) or Electronic Funds Transfer (EFT) agreement. 2. You are a member in good standing and current with all Scheduled Monthly Payments at the time your written request is submitted. 3. You have made all prior Scheduled Monthly Payments by RCC/EFT on a timely basis. 4. Your current Scheduled Monthly Payment is higher than the advertised monthly payment by at least one dollar per month, exclusive of additional amenities, fees, card fees, processing fees, personal training fees, or renewal term monthly payments. 5. Your “Total Due Today” amount on your contract is equal to or greater than the “Total Due Today” amount required to be paid by new members upon joining. 6. You make all future reduced Scheduled Monthly Payments by RCC/EFT on a timely basis, otherwise your Scheduled Monthly Payment amount will revert to amount stated in your original membership agreement. The Bally Assurance Program does not apply to a Premier National Access Commitment Membership that: 1. Is sold online, is not sold in a specific Bally Total Fitness club, or is sold at a Bally franchise club; 2. Has monthly rates that have been reduced as a result of promotional discounts, including, but not limited to dollars-off coupons, loyalty program discounts or family add-on promotions, or has monthly rates that are not available to the general public, including, but not limited to corporate discounts, reactivation offers, employee specials or family add-ons. 3. Is not referred to as “Premier National Access Commitment Membership” on the Membership Agreement and in the advertisement. 4. Has been previously frozen, reduced, or cancelled based upon another Commitment Membership benefit, program, promise, option, assurance, or privilege; 5. Has a monthly rate that is less than one dollar greater than the advertised lower monthly payment offer.
