1. ELIGIBILITY: Entry into the Bally Total Fitness monthly “My Bally” Sweepstakes (“Sweepstakes”) is open only to Bally Total Fitness (“BTF”) members who (a) 18 or older and are legal U.S. residents; (b) are current on all payments to BTF and in good standing; (“Member(s)”). Employees of Bally Total Fitness, its advertising agencies and suppliers, and previous winners in this Sweepstakes are not eligible to enter.
2. HOW TO ENTER: Members will receive 1 Sweepstakes entry for registering an account at www.mybally.com. Members can only register once and therefore only be eligible for the contest during the month they register. Members may also enter their contact information at the front desk of any participating Bally club to include a valid email address as an alternate form of entry. Sweepstakes begins 11/1/09 and ends on 11/30/09. All subsequent national/monthly Sweepstakes begin on the 1st of each succeeding month and end on the last calendar day of that month through 6/30/10. Eligible entries during each monthly Sweepstakes period are valid for that Sweepstakes only. Each national/monthly period constitutes a separate Sweepstakes and non-winning entries will not be entered in subsequent monthly drawings. All entries must be received no later than 11:59:59 p.m. (EDT) in each Sweepstakes Period. All entries become the property of Sponsor.
3. RANDOM DRAWING: One (1) winner of each monthly Sweepstakes will be selected in a random drawing from among all eligible entries timely received for that Sweepstakes Period by Bally Total Fitness Corporation (“Sponsor”) whose decisions are final. Drawings for monthly winners will be held on or about the second business day after each monthly Sweepstakes. Potential winners will be notified by telephone or e-mail. Odds of winning depend upon the number of eligible entries received for each separate Sweepstakes period.
4. PRIZE: EMPP members, 1-time payment plan members & members who are in their renewal term will receive a certificate redeemable for one (1) year free of membership. Value members, Committed or any members with an outstanding balance owed to Bally will receive a certificate redeemable for a credit of (12) months of payments. Member must be in good standing and current on all payments at the time of certificate redemption. Limit One (1) Certificate Per Member. Members are responsible for properly completing the certificate for processing and mailing it to Bally Total Fitness Services P.O. Box 1090, Norwalk CA, 90651. Certificate must be redeemed within 90 days after Prize is awarded to winner.
5. ELIGIBILITY: Open only to individuals who, on the day they enter the Sweepstakes, are 18 or older, are U.S. residents (excluding residents of Alaska, Alabama, Arkansas, Delaware, Hawaii, Idaho, Iowa, Kentucky, Louisiana, Montana, Mississippi, Nebraska, North Dakota, New Hampshire, New Mexico, Nevada, Oklahoma, South Carolina, South Dakota, Tennessee, Vermont, West Virginia, Wyoming, and Puerto Rico and other US territories) and are current Bally members in good standing. Entries from outside of the eligible states will not be accepted. Void where prohibited by law. Employees of Bally Total Fitness, their affiliates, subsidiaries, advertising and promotion agencies or any individuals involved in telephone recording activities in connection with this Sweepstakes promotion and their immediate family members and/or those living in the same household of each are not eligible.
6. GENERAL RULES: Selected entries may be subject to verification. All federal, state, and local laws apply. All federal, state, and local taxes are the sole responsibility of winner. Inability to contact Prize winner by telephone or e-mail will result in disqualification and an alternate winner will be selected. Prize certificates will be mailed to monthly winners. Sponsor is not responsible for certificates that are returned due insufficient address or that are undeliverable for any reason. No Prize substitutions except at the sole discretion of Sponsor, who reserves the right to substitute prize of equal or greater value. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend any Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the person fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Acceptance of Prize constitutes permission to the Sponsor and its agencies to use winner’s name and/or likeness for purposes of advertising and trade in all media worldwide without further compensation, unless where prohibited by law. By participating in this promotion and individual Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the judges. By accepting Prize, winner agrees to hold Sponsor harmless against any and all claims and liability arising out of use of Prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused by participation in this Sweepstakes or use or redemption of the Prize. PURCHASE OR ACCEPTANCE OF A PRODUCT OFFER DOES NOT IMPROVE YOUR CHANCES OF WINNING. By providing us with your email address, you provide us with expressed consent to receive pre-recorded messaging and other communications of any kind including, mail, electronic and telephonic from Bally Total Fitness regarding membership matters, news and updates, promotional offers and other items of interest.
